てくとこ 利用規約

本利用規約（以下「本規約」）は、「てくとこ - おさんぽSNS」（以下「本アプリ」）の運営者（以下「当方」）が提供する本アプリの利用条件を定めるものです。登録ユーザーの皆さま（以下「ユーザー」）には、本規約に従って本アプリをご利用いただきます。

第1条（適用）

本規約は、本アプリの利用に関わる一切の関係に適用されます。

第2条（利用登録）

  1. 利用登録を希望する方は、本規約に同意の上、当方の定める方法によって利用登録を申請するものとします。
  2. 当方は、以下の場合には登録を承認しないことがあります。
    • 登録申請に際して虚偽の事項を届け出た場合
    • 本規約に違反したことがある者からの申請である場合
    • その他、当方が利用登録を相当でないと判断した場合

第3条（アカウント管理）

  1. ユーザーは、自己の責任においてアカウント情報を管理するものとします。
  2. ユーザーはいかなる場合にも、アカウントを第三者に譲渡または貸与することはできません。
  3. 当方は、ログイン情報が一致した場合には、そのアカウントを保有するユーザー自身による利用とみなします。
  4. ユーザーは、アプリ内の「設定」画面からいつでもアカウントを削除できます。アカウント削除により、以下の処理が実行されます。
    • Firebase Authenticationのアカウント情報の恒久的削除
    • Firestoreに保存された全ての散歩記録の恒久的削除
    • Firebase Storageに保存された全ての写真・画像データの恒久的削除
    • 共有リンクを通じて公開された情報の削除
  5. アカウント削除後、削除されたデータの復元はできません。削除前に必要なデータはバックアップすることを推奨します。
  6. セキュリティ上の理由により、アカウント削除時に再度ログインを求める場合があります。

第4条（利用料金）

本アプリの基本機能は無料でご利用いただけます。将来的に有料機能を追加する場合は、事前にお知らせします。

第5条（禁止事項）

ユーザーは、本アプリの利用にあたり、以下の行為をしてはなりません。

  1. 法令または公序良俗に違反する行為
  2. 犯罪行為に関連する行為
  3. 当方、他のユーザー、その他第三者の知的財産権、肖像権、プライバシー、名誉その他の権利を侵害する行為
  4. 過度に暴力的な表現、性的な表現、その他不適切な内容を投稿する行為
  5. 営業、宣伝、広告、勧誘、その他営利を目的とする行為
  6. 虚偽の情報を投稿する行為
  7. 不正アクセス、またはこれを試みる行為
  8. 他のユーザーに成りすます行為
  9. 当方のアプリの運営を妨害するおそれのある行為
  10. その他、当方が不適切と判断する行為

第6条（本アプリの提供の停止等）

  1. 当方は、以下のいずれかの事由があると判断した場合、ユーザーに事前に通知することなく本アプリの全部または一部の提供を停止または中断することができるものとします。
    • 本アプリにかかるコンピュータシステムの保守点検または更新を行う場合
    • 地震、落雷、火災、停電または天災などの不可抗力により、本アプリの提供が困難となった場合
    • その他、当方が本アプリの提供が困難と判断した場合
  2. 当方は、本アプリの提供の停止または中断により、ユーザーまたは第三者が被ったいかなる不利益または損害についても、一切の責任を負わないものとします。

第7条（著作権）

  1. ユーザーが本アプリを利用して投稿した写真、テキスト、その他のコンテンツの著作権は、ユーザーに帰属します。
  2. ユーザーは、本アプリに投稿したコンテンツについて、当方が本アプリの運営、改善、プロモーションのために必要な範囲で使用することを許諾するものとします。

第8条（免責事項）

  1. 当方は、本アプリに関して、ユーザーと他のユーザーまたは第三者との間において生じた取引、連絡または紛争等について一切責任を負いません。
  2. 当方は、本アプリの提供の中断、停止、終了、利用不能または変更、ユーザーが本アプリに送信したメッセージまたは情報の削除または消失、ユーザーの登録の抹消、本アプリの利用によるデータの消失または機器の故障もしくは損傷、その他本アプリに関してユーザーが被った損害につき、賠償する責任を一切負わないものとします。
  3. 本アプリに関連してユーザーが被った損害について、当方の責に帰すべき事由による場合であっても、当方は、付随的損害、間接損害、特別損害、将来の損害および逸失利益にかかる損害については、賠償する責任を負わないものとします。

第9条（アプリ内容の変更等）

当方は、ユーザーに通知することなく、本アプリの内容を変更しまたは本アプリの提供を中止することができるものとし、これによってユーザーに生じた損害について一切の責任を負いません。

第10条（利用規約の変更）

  1. 当方は、必要と判断した場合には、ユーザーに通知することなくいつでも本規約を変更することができるものとします。
  2. 変更後の本規約は、アプリ内で通知された時点から効力を生じるものとします。
  3. 本規約の変更後、本アプリの利用を継続したユーザーは、変更後の本規約に同意したものとみなします。

第11条（個人情報の取扱い）

当方は、本アプリの利用によって取得した個人情報を本アプリのプライバシーポリシーに基づき適切に取り扱います。

第12条（通知または連絡）

ユーザーと当方との間の通知または連絡は、当方の定める方法によって行うものとします。当方は、ユーザーからの変更届出がない限り、現在登録されている連絡先を有効なものとみなします。

第13条（権利義務の譲渡禁止）

ユーザーは、当方の書面による事前の承諾なく、本規約に基づく地位または権利若しくは義務を第三者に譲渡し、または担保に供することはできません。

第14条（準拠法・裁判管轄）

  1. 本規約の解釈には日本法を準拠法とします。
  2. 本アプリに関して生じた紛争については、当方の所在地を管轄する裁判所を専属的合意管轄とします。

The English translation is provided for reference. In the event of any discrepancy, the Japanese version shall prevail.

TekuToko Terms of Service

These Terms set forth the conditions for use of the "TekuToko - Walking SNS" app provided by the operator ("we"). Registered users ("Users") shall use the App according to these Terms.

Article 1 (Application)

These Terms apply to all relationships related to App use.

Article 2 (Registration)

  1. Individuals wishing to register shall apply using the method prescribed by us after agreeing to these Terms.
  2. We may refuse registration when:
    • false information was provided;
    • the applicant previously violated these Terms; or
    • we otherwise deem registration inappropriate.

Article 3 (Account Management)

  1. Users shall manage their account information at their own responsibility.
  2. Users may not transfer or lend their account to third parties.
  3. We treat use with matching login information as use by the account holder.
  4. Users may delete their account at any time from the "Settings" screen within the App. Account deletion performs the following actions:
    • Permanent deletion of Firebase Authentication account information
    • Permanent deletion of all walk records stored in Firestore
    • Permanent deletion of all photos and image data stored in Firebase Storage
    • Deletion of information published through share links
  5. Deleted data cannot be restored after account deletion. We recommend backing up necessary data before deletion.
  6. For security reasons, re-authentication may be required when deleting an account.

Article 4 (Usage Fees)

Basic App features are free. We will notify users if paid features are added.

Article 5 (Prohibited Actions)

Users must not engage in the following:

  1. actions violating laws or public order;
  2. actions related to criminal activity;
  3. infringing the rights of us, other users, or third parties;
  4. posting violent, sexual, or otherwise inappropriate content;
  5. commercial promotions or solicitations;
  6. posting false information;
  7. unauthorized access or attempts thereof;
  8. impersonating other users;
  9. actions that may interfere with App operations; and
  10. other actions deemed inappropriate by us.

Article 6 (Suspension of App)

  1. We may suspend or interrupt the App without notice when maintenance is performed, provision becomes difficult due to force majeure, or we otherwise determine provision is difficult.
  2. We bear no responsibility for damages caused by suspension or interruption.

Article 7 (Copyright)

  1. Users retain copyright for content they post.
  2. Users grant us permission to use posted content for App operation, improvement, and promotion.

Article 8 (Disclaimer)

  1. We bear no responsibility for disputes between Users and other parties.
  2. We are not liable for damages arising from interruption, suspension, termination, unavailability, changes, deletion of data, account deletion, data loss, or device failure.
  3. Even when attributable to us, we are not liable for incidental, indirect, special, future damages, or lost profits.

Article 9 (App Changes)

We may change or discontinue the App without notice and are not liable for resulting damages.

Article 10 (Changes to Terms)

  1. We may change these Terms without notice when necessary.
  2. Changed Terms take effect when announced in the App.
  3. Continued use after changes constitutes acceptance.

Article 11 (Handling of Personal Information)

Personal information obtained through App use is handled according to our Privacy Policy.

Article 12 (Notifications)

Notifications between Users and us follow methods prescribed by us. Registered contact information is deemed valid unless updated.

Article 13 (Prohibition of Assignment)

Users may not assign or pledge their contractual position or rights and obligations without our prior written consent.

Article 14 (Governing Law and Jurisdiction)

  1. These Terms are governed by Japanese law.
  2. Courts with jurisdiction over our location have exclusive jurisdiction over disputes.
